New Jersey estate facts · Selling the house

Does a house with a private well need a water test before it's sold in New Jersey?

The short answer

Yes. Under New Jersey's Private Well Testing Act, the well water is tested before the sale, and both buyer and seller review the results before closing.

The details

New Jersey's Private Well Testing Act applies to the sale of any property that gets its drinking water from a private well on the property. The contract of sale must include a testing requirement.

Closing of title can't take place until both the buyer and the seller have received and reviewed a copy of the water test results.

Landlords with private wells also have to test periodically and share results with tenants.

For families settling an estate. For an inherited rural house, the well test is one more step to plan for. It's a standard part of selling.
